These Terms of Service ("Terms") govern your access to and use of the All Aboard Analytics website, dashboard, reports, and data services (collectively, the "Service") operated by All Aboard Analytics ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

All Aboard Analytics provides cruise pricing data, analytics, and reports for informational purposes. The Service includes:

• Access to pricing dashboards and analytics tools
• Weekly and monthly pricing reports
• Data exports (where included in your subscription)
• Related documentation and methodology materials

The Service is designed for institutional investors, equity research teams, and alternative data evaluators. It is not intended for consumer booking decisions.

2. Not Investment Advice

The Service does not constitute investment advice, a recommendation to buy or sell any security, or an offer to provide investment advisory services.

All data, analytics, reports, and other content provided through the Service are for informational purposes only. 3. Account Registration

• Reference our data in your internal models and analysis

You may not:

• Redistribute, resell, or sublicense our data to third parties
• Publish raw data exports publicly
• Use automated systems to scrape or bulk-download data beyond normal use
• Remove or alter any proprietary notices or attributions
• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract underlying data sources

Enterprise and institutional subscriptions may include different usage rights as specified in your subscription agreement.

5. Data and Accuracy

Our data is derived from third-party sources that we believe to be reliable. However:

• Data is provided "as is" without warranty of any kind, express or implied
• We do not guarantee the accuracy, completeness, timeliness, or reliability of any data

7. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to:

• Authorize us to charge your payment method for recurring fees

Subscriptions automatically renew unless cancelled before the renewal date. Fees are non-refundable except as required by law or specified in your subscription agreement.

We reserve the right to modify pricing with 30 days' notice. Price changes will apply to subsequent renewal periods.

8. Confidentiality

If you receive access to non-public features, beta products, or confidential information, you agree to:

• Keep such information confidential
• Use it only for the purposes for which it was provided
• Not disclose it to third parties without our written consent

This obligation survives termination of your account.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, error-free, or secure
• Data will be accurate, complete, or current
• The Service will meet your specific requirements
• Any errors will be corrected

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ALL ABOARD ANALYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Business interruption
• Investment losses
• Trading losses
• Any damages arising from reliance on our data

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless All Aboard Analytics and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any investment decisions you make based on our data

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

Upon termination:

• Your license to use the Service immediately ends
• You must cease all use of our data and materials
• Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive

You may cancel your account at any time by contacting us.

13. Modifications

We may modify these Terms at any time by posting the revised version on our website. Material changes will be communicated via email or dashboard notification.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Miami, Florida, under the rules of the American Arbitration Association. You waive any right to participate in class actions.

For claims under $10,000, disputes may be resolved through small claims court.

15. General Provisions

Entire Agreement: These Terms, together with any subscription agreement, constitute the entire agreement between you and All Aboard Analytics regarding the Service.

Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver.

Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations freely.

Notices: We may provide notices via email, dashboard notification, or posting on our website.
